Terms of Service

These Terms of Service (“Terms”) set out the rules for using GIGAXXX at gigaxxx.com. By using the site, you agree to them, so please read them carefully.

1. Who we are and what these Terms cover

GIGAXXX is run by the operator of GIGAXXX (“GIGAXXX”, “we”, “us”), as set out in our Legal notice. These Terms are a legally binding agreement between you and us for your use of gigaxxx.com, including its pages, video player, features and forms (the “Service”).

Our Anti-CSAM, Anti-Trafficking & Child Safety Policy and DMCA & Copyright Policy form part of these Terms. Where one of them deals with a topic more specifically, it applies to that topic. Our Privacy Policy and Cookie & Storage Policy explain how we handle personal data and browser storage.

2. Accepting these Terms

By accessing or using the Service, you confirm that you accept these Terms and meet the eligibility requirements in section 3. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you confirm that you are authorized to accept these Terms for it.

3. Eligibility: adults only

GIGAXXX contains sexually explicit material intended for adults. You may use the Service only if:

• you are at least 18 years old, or the age of majority where you live, whichever is higher;
• viewing adult content is legal where you are; and
• you choose to view sexually explicit material, knowing what the Service contains.

You are responsible for complying with the laws that apply to you. You must not let minors access the Service on your devices, or show content from the Service to anyone who has not agreed to see it.

There is no age check at entry today. Where the law requires age assurance, we will use a compliant, privacy-preserving method, so that GIGAXXX never sees or stores your identity documents. We may also restrict access from some regions, and we may block anyone we have reason to believe does not meet these requirements.

4. The Service

4.1 Free to watch

GIGAXXX is an adult video streaming website offering free HD videos, organized into straight, gay and trans sections and categories. Watching is 100% free and needs no account. The Service may be funded by advertising in the future; no ads are displayed today.

There is no subscription, premium tier, paywall, pay-per-view, tokens or tips, and there are no live cams or live streams. Videos can be streamed on the Service but not downloaded.

4.2 Features saved in your browser

Watch later, Favorites, your viewing and search history, video resume, your like or dislike on each video and your player preferences are saved in your browser only. We keep no copy of them, so we cannot restore them if you clear your browser data, close a private window or switch devices. When you like or dislike a video, or start playing it, only an anonymous count is added to that video’s public counters. Our Cookie & Storage Policy lists exactly what is stored.

4.3 Availability and changes

We do not guarantee that the Service, or any particular video, will always be available. We may add, change, suspend or remove features or content at any time, for example for legal, security or technical reasons.

5. Acceptable use

You may use the Service only for your own personal, non-commercial entertainment, in line with these Terms and the law. You must not:

• download, record, rip, re-upload, sell, broadcast or otherwise redistribute content from the Service, or use tools designed to do so;
• frame, mirror or embed the Service, or link directly to our video files, without our written permission;
• use bots, scrapers or other automated means to collect content or data from the Service, including to train artificial-intelligence models, except for search-engine indexing that follows our instructions to crawlers;
• use any image, video or likeness from the Service to create sexual deepfakes or other manipulated sexual imagery of real people;
• bypass or interfere with security or access measures, including Cloudflare protections, age-assurance measures and regional restrictions, or disrupt the Service with excessive requests or harmful code;
• harass or threaten anyone, or share anyone’s personal data without their permission (doxxing);
• impersonate anyone, or misrepresent your identity, age or affiliation;
• send spam, run scams or phishing, or use our forms to advertise without our permission;
• knowingly submit false, misleading or bad-faith reports, notices or complaints; or
• help anyone else do any of these things.

6. Prohibited content: zero tolerance

GIGAXXX has zero tolerance for the following material, in any form:

• child sexual abuse material (CSAM), or anything that sexualizes minors, including titles, tags, costumes or role-play that present or suggest a performer as a minor, and age-play framing;
• non-consensual content, including hidden-camera recordings, leaked or “revenge” material, and sexual deepfakes of real people;
• sex trafficking or any other form of sexual exploitation;
• incest themes;
• bestiality;
• sexual violence or gore;
• content involving people who are intoxicated or incapacitated;
• hateful content;
• doxxing, meaning the publication of someone’s personal data; and
• spam and scams.

7. Content and intellectual property

7.1 Third-party content

The videos on GIGAXXX are produced by third-party studios and producers and come from established adult platforms and studios. They, or their licensors, own the rights in those videos. GIGAXXX is not a producer of this content. Titles, descriptions and categories are written by GIGAXXX from the information available about each video, and we do not guarantee that they are complete or accurate.

7.2 Your license to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable license to access the Service and to stream its content through our player for your own non-commercial use. This license does not allow you to download, copy, modify or distribute any content, and it ends automatically if you breach these Terms. We and our licensors reserve all other rights.

7.3 Trademarks and site materials

The GIGAXXX name, logo and tagline are our trademarks, and the design, text, graphics and software of the Service, other than third-party content, belong to us or our licensors. You may not use them without our prior written permission, except to refer to the Service accurately without suggesting endorsement or affiliation.

7.4 Feedback

If you send us ideas or suggestions, for example through our contact form, you allow us to use them freely and without any obligation to you.

7.5 Copyright

We respond to copyright notices under the US Digital Millennium Copyright Act (DMCA) and similar laws. Send notices and counter-notices through our contact form, as explained in our DMCA & Copyright Policy. We process valid notices expeditiously. The US Copyright Office provides general information about the DMCA.

8. Reporting content and removal requests

Anyone can tell us about content they believe is illegal or breaks our rules:

• Report a video: use the Report button under every video, which opens a short report form, or our contact form.
• Content that shows you without your consent: use our contact form and choose “Remove my content”.
• Copyright: send a notice through our contact form under our DMCA & Copyright Policy.

Our forms send your message directly to our team. To help us act quickly, include the exact URL of the content and why you believe it is illegal or breaks our rules. If you want an answer, give us an email address. Reports of suspected child sexual abuse material do not need to include your name.

Reports involving minors or non-consensual content are prioritized. If you give us your email address, we confirm what we decided.

9. How we handle reports

Every report is reviewed by our team. Illegal content is removed. Depending on the case, we may also:

• disable access to content everywhere or in some regions;
• correct or remove misleading titles, descriptions, categories or tags;
• stop publishing content from a source that repeatedly provides content that breaks our rules;
• report apparent child sexual abuse material to NCMEC and other competent authorities as required, and preserve evidence as the law requires; and
• inform the competent authorities of information suggesting a crime that threatens someone’s life or safety.

We apply our rules diligently, objectively and proportionately, with due regard to the rights and legitimate interests of everyone involved, including freedom of expression. If you disagree with a decision we made about your report, tell us why through our contact form: someone who was not involved in the first decision will look at it again.

If someone frequently submits manifestly unfounded reports or notices, we may, after a warning, stop processing their reports and notices for a reasonable period.

10. Privacy and cookies

Our Privacy Policy explains how we handle personal data, and our Cookie & Storage Policy explains what is stored in your browser. In short, GIGAXXX itself sets no cookies at the moment, our server logs are deleted automatically after about 5 days, we use no analytics tools, advertising cookies or third-party trackers, and the statistics we use to rank videos are anonymous.

11. Third-party links and advertising

We are not responsible for the content or practices of third-party websites we link to, such as support organizations and reporting hotlines, and a link is not an endorsement.

No ads are displayed on the Service today. If advertising starts, ads will be identified as advertising, as the law requires, and any analytics or advertising cookies will stay off until you agree where the law requires consent. We will update our Cookie & Storage Policy and Privacy Policy first. Your dealings with advertisers are between you and them.

12. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”. We do not promise that it will be uninterrupted, secure or error-free, that any content will remain available, or that titles, categories and tags are accurate. We are not responsible for the loss of data saved in your browser. Your statutory rights as a consumer are not affected (see section 13).

13. Limitation of liability

To the fullest extent permitted by law:

• we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, goodwill, opportunity or data, arising out of or in connection with the Service or these Terms; and
• our total liability for all claims relating to the Service or these Terms is limited to the amount, if any, that you paid us for the Service in the 12 months before the event giving rise to the claim.

These limits apply whatever the legal basis of the claim, whether contract, tort (including negligence), strict liability or otherwise, even if we were told that the loss was possible.

14. Indemnity

To the extent permitted by law, you agree to indemnify GIGAXXX and its staff, contractors and agents against claims, losses and costs, including reasonable legal fees, arising from your breach of these Terms, your misuse of the Service, or your violation of any law or anyone’s rights. This does not apply if you are a consumer and the law where you live does not allow it.

15. Suspension and termination

You can stop using the Service at any time. Our Cookie & Storage Policy explains how to remove what it saved in your browser.

We may restrict, suspend or end your access to all or part of the Service, including by blocking some networks or regions, if you breach these Terms, if the law or a competent authority requires it, if needed to protect the Service, its users, performers or others from harm, fraud or security threats, or if you repeatedly infringe intellectual property rights.

For serious breaches, including anything covered by our zero-tolerance rules, we may act immediately and without warning. In other cases, we will normally warn you first.

The sections on intellectual property, disclaimers, limitation of liability, indemnity and governing law continue to apply after your use ends.

16. Changes to these Terms and to the Service

We may update these Terms, for example when we add features or advertising, or when the law changes. We will publish the new version on this page and change the “last updated” date. For significant changes, we will give reasonable notice before they take effect, for example with a notice on the Service, unless a change must apply sooner for legal or security reasons.

If you keep using the Service after a change takes effect, you accept the updated Terms; if you do not agree, stop using it. We may also change the Service itself (section 4.3).

17. Governing law and disputes

These Terms, and any dispute arising out of or in connection with them or the Service, are governed by the laws of the country in which the operator of GIGAXXX is established, as stated in our Legal notice, without depriving you of mandatory protections of the country where you live.

Before starting formal proceedings, please write to us through our contact form, choosing “Law enforcement / legal” for legal notices, so that we can try to resolve the matter informally.

Unless mandatory law provides otherwise, the competent courts of the country in which the operator of GIGAXXX is established have jurisdiction. If you are a consumer, you may also bring proceedings in the courts of the country where you live when the law gives you that right.

18. General

• Entire agreement. These Terms and the policies they refer to are the entire agreement between you and us about the Service.
• Severability. If any provision is found invalid or unenforceable, the rest of these Terms remains in effect.
• No waiver. If we do not enforce a provision right away, we can still enforce it later.
• Transfer. You may not transfer your rights or obligations under these Terms. We may transfer ours to another organization that takes over the operation of GIGAXXX, provided your rights are not reduced.
• Language. These Terms are written in English, and the English version prevails over any translation to the extent the law allows.
