18 U.S.C. § 2257 Record-Keeping Requirements Compliance Statement

This statement explains how the operator of GIGAXXX (“GIGAXXX”, “we”, “us”) relates to the record-keeping requirements of 18 U.S.C. § 2257 and its regulations, 28 C.F.R. Part 75. Details of the operator are set out in our Legal notice.

Age of performers

All persons who appear in any visual depiction of actual or simulated sexually explicit conduct on GIGAXXX were 18 years of age or older at the time the depiction was created.

GIGAXXX is not a producer

GIGAXXX is not a primary producer or a secondary producer, as those terms are used in 18 U.S.C. § 2257 and 28 C.F.R. Part 75, of any visual content on this website. The videos on GIGAXXX are produced by third-party studios and producers. We do not film or produce any content, and we do not hire performers or arrange for their participation in any production.

Where the records are kept

The producers of the content, meaning the studios and producers who made it, must create and maintain the records required by 18 U.S.C. § 2257 and, where applicable, 18 U.S.C. § 2257A and 28 C.F.R. Part 75. These records, which include identification documents for every performer, are kept by each producer’s custodian of records.

Our safeguards before publication

Our own rules add further safeguards. We publish only videos that come from established adult platforms and studios, which operate under their own age-verification and record-keeping obligations. Before a video is published on GIGAXXX, its information is screened: anything that suggests a minor, non-consent or incest is rejected, flagged videos get a second review, and titles and descriptions never use words that suggest a performer is under 18. These safeguards add to, and do not replace, each producer’s own record-keeping obligations.

How to request custodian-of-records information

To request the custodian-of-records details for the producer of a video on GIGAXXX, use our contact form, choose “Law enforcement / legal” and include:

• the full address (URL) of each video page concerned;
• your name, your organization if you are writing on its behalf, and how we can contact you.

We will reply with the information we hold about the producer of each video, so that you can contact its custodian of records.

Exempt material

Not all material on GIGAXXX is subject to these record-keeping requirements. For example, material that does not depict actual or simulated sexually explicit conduct, or that is otherwise exempt under the law, does not require these records. Our age and consent rules apply to all content on GIGAXXX, whether or not it is exempt.

Reporting a concern

If you believe any content on GIGAXXX shows a person under 18, report it immediately with the Report button under the video or through our contact form. Reports involving minors are prioritized. Read more in our Anti-CSAM policy.
